ASCEND PRIVACY & SECURITY

ASCEND Cardiovascular (“ASCEND” “we” or “us”) is committed to protecting the privacy and security of your personally-identifying information. We have prepared this Privacy Policy to explain how we collect, use, protect, and disclose your Personal Information, Usage Data and Message Data (as those terms are defined below) when you use the ASCEND website (the “Website”),  or the Catalyst LEARN® enterprise messaging solution (the “Solution”), either as an online service (“Catalyst LEARN SaaS”), or as a mobile device application (“Catalyst LEARN Application”), all collectively known as “the Services."

What information does ASCEND obtain and how is it used?

ASCEND Cardiovascular Website
We are the sole owners of the information collected on the Website and/or the Solution. We only have access to/collect information that you voluntarily give us via email or other direct contact from you (“User Provided Information”). We will not sell or rent User Provided Information to anyone. We will use User Provided Information to respond to you, regarding the reason you contacted us. We will not share your User Provided Information with any third party outside of our organization, other than as necessary to fulfill your request.

Catalyst LEARN®
USAGE DATA
Catalyst LEARN also obtains User Provided Information when you sign into the Solution. We also automatically collect usage information that allows us to track and analyze how users access and use Catalyst LEARN (“Usage Data”).  We also automatically collect information on the type of device you use and the device identifier (“UDID”).

MESSAGE DATA
When you send or receive messages using Catalyst LEARN, we process and store your messages, log and contact data, shared screenshots, and other related information (“Message Data”) in order to provide these Services to you.

LOCATION DATA
Catalyst LEARN collects precise information about the location of your mobile device or web browser (“Location Data”).

Catalyst LEARN SaaS
Each time you use Catalyst LEARN SaaS, we automatically collect information regarding the type of web browser you use, your operating system, your Internet Service Provider, your IP address, the pages you view on our Site, the time and duration of your visits to the Site, crash logs and other information relating to your use of the Services (“Automatically Collected SaaS Data”).We use Automatically Collected SaaS Data, User Data, Message Data, and Location Data to analyze trends, administer the Services, troubleshoot any user problems, and to enhance and update the Services.

COOKIES AND DO NOT TRACK
A cookie is a small piece of text sent to your browser by a website you visit. It helps the website to remember information about your visit, like your preferred language and other settings. We use cookies on Catalyst LEARN SaaS to improve the quality of the Services, not to collect personal information. Most web browsers are initially set up to accept cookies, and while you can reset your web browser to refuse them or to indicate when a cookie is being sent, certain functions of Catalyst LEARN may not function if you change these settings. THE SITE’S COOKIES DO NOT AND CANNOT INFILTRATE A USER’S HARD DRIVE TO COLLECT ANY INFORMATION STORED ON THE HARD DRIVE.

Catalyst LEARN does not support Do Not Track requests from browsers capable of doing so, which means that we collect information about your online activity while you are using Catalyst LEARN.

Catalyst LEARN Application
The Catalyst LEARN Application may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile device’s UDID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browsers you use, and information about the way you use the Application (“Automatically Collected Application Data”).We use Automatically Collected Application Data, User Data, Message Data, and Location Data to analyze trends, administer the Services, troubleshoot any user problems, and to enhance and update the Services.

 

Do third parties see and/or have access to information obtained by ASCEND Services?

We will share your information with third parties only in the ways that are described in this privacy statement.
We may collect and transmit aggregated, anonymized data to external services to help us improve the Services.
We may disclose User Provided and Collected Information:

  • as required by law, such as to comply with a subpoena, or similar legal process;
  • when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request;
  • if ASCEND is involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via email of any change in ownership or uses of this information, as well as any choices you may have regarding this information.

What are my opt-out rights?
You can stop all collection of information by ASCEND easily by disuse of ASCEND Services. For the Catalyst LEARN Application, you may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network.

Data Retention Policy, Managing Your Information
We will retain User Provided Information for as long as you use the Services and for a reasonable time thereafter. We retain Usage Data, Message Data, Location Data, Automatically Collected SaaS Date and Automatically Collected Application Data.

If you’d like us to delete Personally Identifiable User Provided Information that you have provided via the Services, such as your name, address, email address or phone number, please contact us at information@ascendhit.com and we will respond in a reasonable time. Please note that some or all of the User Provided Information may be required in order for the Services to function properly.

California “Shine the Light” Law
California Civil Code Section 1798.83, known as the “Shine The Light” law, permits our Members who are California residents to request and obtain from us a list of what personal information (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year and the names and addresses of those third parties. Requests may be made only once a year and are free of charge. Under Section 1798.83, we currently do not share any personal information with third parties for their direct marketing purposes.

Security
We are concerned about safeguarding the confidentiality of your information. We provide physical, electronic, and procedural safeguards to protect information we process and maintain. Other than the recipients to whom you explicitly share information, we limit access to this information to authorized employees and contractors who need to know that information in order to operate, develop or improve our services. Please be aware that, although we endeavor provide reasonable security for information we process and maintain, no security system can prevent all potential security breaches.

Changes
This Privacy Policy may be updated from time to time for any reason. We will notify you of any changes to our Privacy Policy by posting the new Privacy Policy to the ASCEND website. You are advised to consult this Privacy Policy regularly for any changes, as continued use is deemed approval of all changes. You can check the history of this policy by referring to the version number of this policy at the top of the page.

Your Consent
By using the Services, you are consenting to our processing of your information as set forth in this Privacy Policy now and as amended by us. "Processing,” means using cookies on a computer/hand held device or using or touching information in any way, including, but not limited to, collecting, storing, deleting, using, combining and disclosing information, all of which activities will take place in the United States. If you reside outside the United States your information will be transferred, processed and stored there under United States privacy standards.

The Services are intended for use by United States residents. Those who access or use the Services from jurisdictions outside the United States do so at their own choice and risk and are solely responsible for compliance with local law. If you are not a resident of the United States, you acknowledge and agree that we may collect and use your personal information outside your home jurisdiction, and that we may store your personal information in the United States or elsewhere. Please note that the level of legal protection provided in the United States or other non-European countries from which you may access the Services may not be as stringent as that under European Union privacy standards or the privacy laws of some other countries, possibly including your home jurisdiction.
